Terms of Service

These Terms of Service ("Terms") govern your use of the CreatyMoat platform ("Service"). By creating an account or using the Service, you agree to be bound by these Terms. Please read carefully.
1. The Service
CreatyMoat provides AI-powered social media content generation, scheduling, publishing, and inbound-message handling for businesses. The Service includes the web application, APIs, AI agents, and any related tools we offer.
2. Your Account
- You must be 18+ and legally able to enter a binding agreement.
- You are responsible for the security of your account credentials.
- You must provide accurate information and keep it up to date.
- One person or business per account unless agreed otherwise.
3. Content & Brand Access
To operate, CreatyMoat requires limited access to your social media accounts through their official OAuth flows (Meta Graph API, TikTok Business API). We never ask for passwords. Tokens are encrypted at rest. You may revoke access at any time via the platform's native settings.
You retain full ownership of all content posted to your accounts. By using the Service, you grant us a limited license to generate, schedule, and publish content on your behalf solely for the purpose of providing the Service.
4. Acceptable Use
You agree not to:
- Publish illegal, defamatory, hateful, or discriminatory content.
- Make false medical, legal, financial, or outcome-based claims.
- Impersonate others or misrepresent your business.
- Abuse the platform to spam, harass, or circumvent rate limits.
- Reverse-engineer, resell, or clone the Service.
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.
5. AI-Generated Content
The Service uses large language models and image generation systems. While we take reasonable steps to produce accurate, on-brand, compliant output:
- AI output may contain errors, factual inaccuracies, or cultural missteps.
- Every post passes through an approval queue by default; you are responsible for reviewing before publication.
- If you enable auto-publish, you accept responsibility for all published content.
- We are not liable for consequences of content you approve or auto-publish.
6. Payments & Subscription
Paid plans are billed monthly in advance via Stripe. Prices are displayed in USD with local-currency equivalents shown for convenience. You may cancel at any time through your dashboard; cancellation takes effect at the end of the current billing period. See our Refund Policy.
7. Data Processing
We process customer data in accordance with our Privacy Policy. We are a data processor when handling your followers' DMs and comments; you remain the controller. Data is retained while your account is active and for up to 90 days after cancellation for backup purposes, unless a longer retention is required by law.
8. Intellectual Property
The Service, including software, designs, and agent logic, is owned by CreatyMoat and protected by intellectual property law. No rights are transferred except the limited license to use the Service as described in these Terms.
9. Limitation of Liability
To the maximum extent permitted by law, CreatyMoat's total liability for any claim arising from or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via email and/or in-app notification at least 14 days in advance. Continued use of the Service after changes take effect constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, USA. Disputes will be resolved in the courts of Delaware, unless otherwise agreed in writing.
